  1. ELIGIBILITY: The Contest is an invitational strictly open to six (6) filmmakers ("Team Leaders") selected from entrants of the New York 48 Hour Film Project 2012. All participants must be legal residents of the United States who are 18 years of age or older. The following are not eligible: employees, contractors, directors and officers of Hearst Communications Inc. ("Hearst"), 48 Hour Film Project, Inc., and each of their respective parent, subsidiaries and affiliated companies, distributors, web design, advertising, fulfillment, judging and Contest agencies involved in the administration, development, fulfillment and execution of this Contest (collectively, "Contest Parties"), and the immediate family members of each (spouse, parent, child, sibling, grandparent, and spouse or "step" of each) and those living in their same households (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of the Contest). Void where prohibited.

  2. TO PARTICIPATE: Team Leaders will be required to sign the Designer Visions 48 Hours Film Project Invitational Team Leader Agreement. On the designated competition weekend, Team Leaders will receive an assignment and will have 48 hours to create and submit a video entry (an "Entry") that integrates a partner brand. The Designer Visions 48 Hour Film Project Invitational assignment will be provided at the Kickoff Event on either September 14 or September 21. Eligible Entries will be judged based on the judging criteria stated below. Team Leaders, or a representative from each team, must be present at the designated times at the Kickoff Event to participate. Each Assignment will include required elements that must appear in the Entry, such as a specific character, prop and/or line of dialogue. In addition, the Assignment will include a required location—one of three Designer Visions Apartments ("Apartment") located at 250 West Street in New York City—and a partner brand—most likely Benjamin Moore Paints or Jenn Air appliances. To be eligible for the Contest, Entries must be the original work of the Team Leader; must not infringe third-party's rights; must be suitable for publication (i.e., may not be obscene or indecent); must not contain obscene or pornographic material; may not contain defamatory statements about any person, company, organization or entity; may not invade privacy or other rights of any person, company or entity; may not in any other way violate applicable laws and regulations; and may not contain any copyrighted elements (other than as owned by the Team Leader and/or Partner). Entries containing prohibited or inappropriate content as determined by 48HFP, in its sole discretion, to be inappropriate will be disqualified. 48HFP reserves the right to make the final determination as to which Entries are eligible. By submission of an Entry, Team Leader agrees to irrevocably assign and transfer all right, title and interest in the Entry, including without limitation copyrights, to Hearst. Assignment of rights in the Entry to Hearst gives Hearst and its agents the unconditional right to publish, use, adapt, edit and/or modify such Entry in any way, in any and all media, without limitation, and without consideration to the Team Leader, whether or not such Entry is selected as a winning Entry. Hearst may, at its sole discretion, use such Entry for any purpose whatsoever, including without limitation, any commercial or advertising purpose or for inclusion, in whole or in part, in any marketing, advertising, sales or promotional materials. Entries that do not include all required information and adhere to the foregoing and following requirements will be considered void and will not be considered in this Contest.

  3. CONTEST TERMS OF SUBMISSION: By submitting an Entry into this Contest, each Team Leader warrants and represents that the Team Leader owns all rights to the Entry he/she is entering in this Contest, including, without limitation, the video or digital recording, and the performance contained in each Entry, with the exception of any brand assets provided by the Hearst for use by Team Leaders in connection with this Contest. Each Team Leader further warrants and represents that the Team Leader has obtained permission from each person who appears in the Entry to grant the rights to the Contest Parties described in these Official Rules, and can make written copies of such permissions available to the Contest Parties upon request. By submitting an Entry, Team Leader agrees to the Official Rules, and further agrees to indemnify and hold the Hearst, Contest Parties and their respective affiliates, officers, directors, agents, co-branders or other partners, and any of their employees (collectively, the "Contest Indemnitees"), harmless from any and all claims, damages, expenses, costs (including reasonable attorneys' fees) and liabilities (including settlements), brought or asserted by any third party against any of the Contest Indemnitees due to or arising out of the Team Leader's Entry Materials in this Contest, or the Entrant's conduct during and in connection with this Contest, including but not limited to trademark, copyright, or other intellectual property rights, right of publicity, right of privacy or defamation. Team Leader agrees to release, indemnify and hold harmless Hearst and the Contest Parties from any and all claims that any advertising, presentation, web content or any other material subsequently produced, presented, and/or prepared by or on behalf of Hearst or the Contest Parties infringes on the rights of Team Leader's work as contained in any Entry.


    Technical Requirememnts

    • The Entry must be a minimum of four (4) minutes in duration, and a maximum of seven (7) minutes in duration.

    • Credits at the end of the Entry are limited to a maximum of 60 seconds. The time allowed for credits is considered additional to the length of the film (e.g., Entry may be 7 minutes long, with an additional 60 seconds of credits, for a total running time of 8 minutes).

    • Sound recorders are allowed. Pre-recorded sound effects are allowed, but Team Leader must have rights of use.

    • The finished film/video must be submitted by 7:30 pm on Sunday night of the competition weekend on one of the following:

      • (preferred) a self-contained HD or SD Quicktime file (.MOV) with no proprietary codecs.
        - codecs for HD: Apple ProRes, Apple Intermediate, H.264, DVCProHD, HDV, Motion JPEG-A, or any native codec from Final Cut, Premiere, Avid, iMovie, or MovieMaker
        - codecs for SD: DV-NTSC, or any of the codecs above
        - frame rate: 23.976 FPS highly recommended
      • data DVD
      • USB flash drive
      • playable DVD (not recommended)

      We recommend that each Team Leader submit two copies of the final Entry; if the Entry cannot be viewed on 48HFP equipment it will be disqualified.

    • Before the finished Entry begins, the submission should have:

      • 5 seconds of bars and tone
      • 5 seconds of black
      • Title card with: Team name, date, city, title and genre
      • Title card with: "This film made for the Designer Visions 48 Hour Film Project Invitational 2012"
      • 2 seconds of black

    Additional Requirements

    • At least 40% of the Entry must be set in the assigned Designer Visions Apartment.

    • Entry must be primarily in English.

    • Only Entries that meet the submission deadline will be eligible. Each participating Team Leader must have a representative at the official Contest on-site event.

    • No Entries will be returned. Contest Parties may, in their sole discretion, disqualify Entries deemed to be inappropriate or otherwise non-compliant.

    • If any group of individuals elects to collaborate on an Entry, they are required to designate one (1) person as the agent of the group to enter the Contest, agree to these Official Rules and accept the prize on behalf of the group. Neither Hearst nor any of the Contest Parties are liable for any disputes between collaborators arising under or related to the Contest.

    • All creative work must occur during the Contest Period, including but not limited to:

      • Writing the Script
      • Rehearsing
      • Costume/Set Design
      • Shooting
      • Editing
      • Sound Design

    • The only work to begin prior to the Contest Period is:

      • Organizing Crew
      • Organizing Cast
      • Securing Equipment
      • Scouting/Securing Locations

    • All cast and crew must be volunteers.

    • The special SAG 48HFP Waiver does not apply to this Contest.

    • No stock footage or footage shot or created at another time may be used in Entry.

    • Animation and special effects are permitted, but must be created during the Contest Period.

    • Still photographs are permitted, provided that the Entrant has the rights of use. The photos do not need to be created during the Contest Period.

    • The Team Leader must submit a Certification Statement with his/her completed Entry, certifying adherence to all Official Rules.

  5. SELECTION OF WINNERS: Entries will be judged by a process in which a qualified panel or panels of judges ("Judges") will evaluate each eligible Entry based on the following:

    Judging criteria for Best Film:

    • Creativity (40%)
    • Technical Merit (30%)
    • Adherence to the Assignment (30%)

    The Top Entry for Best Film will be declared the winner. In the event of a tie, the tie will be broken based on the highest score in the first Judging Criteria, continuing thereafter to each Judging Criteria in order, as needed to break the tie.

    Judging Criteria for Best Brand Integration:

    • Brand Integration (50%)
    • Creativity (30%)
    • Technical Merit (20%)

    The Top Entry for Best Brand Integration will be declared the winner. In the event of a tie, the tie will be broken based on the highest score in the first Judging Criteria, continuing thereafter to each Judging Criteria in order, as needed to break the tie.

    Team Leaders agree that the 48HFP has the sole right to decide all matters and disputes arising from this Contest and that all decisions of 48HFP are final and binding.

  6. PRODUCTION STIPENDS: Each Team Leader will receive a Production Stipend that consists of a $500 check that may be used towards expenses incurred in connection with the production of the Entry. In the event that the Team Leader does not submit an entry, Team Leader will reimburse the 48HFP the $500 stipend.

  7. CONTEST PRIZES: The Award winners will be announced at a special screening and will be awarded the following prizes:

    ONE (1) BEST FILM PRIZE: a check payable to winner in the amount of $2,500 US.

    ONE (1) BEST BRAND INTEGRATION PRIZE: a check payable to winner in the amount of $2,500 US.

  8. GENERAL CONDITIONS: Prize winners are solely responsible for any taxes on the prize, and prize winners will receive an IRS Form 1099 for the ARV of the prize. Prizes are non-transferable. By participating, Team Leaders agree to these Official Rules which are final and binding in all respects. Unclaimed prizes will not be awarded. Finalists will be notified by phone and/or mail and will be required to complete, sign and return an Affidavit of Eligibility/Liability Release, and, where lawful, a Publicity Release within ten (10) days of attempted notification or prize may be forfeited. This Contest is offered only in the United States and is governed by the laws of the District of Columbia, with venue in Washington, DC, and all claims must be resolved in the federal or state courts located in Washington, DC.

  9. LIMITATIONS OF LIABILITY AND RELEASE: No liability or responsibility is assumed by Hearst or Contest Parties resulting from any user's participation in or attempt to participate in the Contest or ability or inability to upload or download any information in connection with participating in the Contest. No responsibility or liability is assumed by the Hearst or Contest Parties for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Contest: hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic, wireless or Internet connectivity or other online communication problems; errors or limitations of any Internet service providers, servers, hosts or providers; garbled, jumbled or faulty data transmissions; failure of any e-mail transmissions to be sent or received; lost, late, delayed or intercepted e-mail transmissions; inaccessibility of the Web Site in whole or in part for any reason; traffic congestion on the Internet or the Web Site; unauthorized human or non-human intervention of the operation of the Contest, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, worms; or destruction of any aspect of the Contest, or loss, miscount, misdirection, inaccessibility or unavailability of an email account used in connection with the Contest. Hearst and Contest Parties are not responsible for any typographical errors in the announcement of prizes or these Official Rules, or any inaccurate or incorrect data contained on the Web Site. Use of Web Site is at user's own risk. Hearst and the Contest Parties are not responsible for any personal injury or property damage or losses of any kind which may be sustained to user's or any other person's computer equipment resulting from participation in the Contest, use of the Web Site or the download of any information from the Web Site. By participating in the Contest, Team Leader agrees to release, indemnify and holdHearst and Contest Parties harmless from any and all claims, damages or liabilities arising from or relating to such Team Leader's participation in the Contest. By accepting a prize in the Contest, winners agree that the Hearst and Contest Parties shall not be liable for any loss or injury resulting from participation in the Contest, acceptance or use of any prize.

  10. WINNERS' LIST/RULES REQUEST: For winner names or Official Rules, send your request with a self-addressed, stamped envelope postmarked by 11/1/12 and received by 11/10/12 "Winners List" or "Rules Request" to: 48 Hour Film Project, Inc., Designer Visions 48HFP, PO Box 40008, Washington, DC 20016. Winners will also be announced to participating teams via email.
